The Office for Civil Rights and Equity serves students and employees who have been impacted by alleged violations of the CSU Nondiscrimination Policy, such as Discrimination or Harassment based on any Protected Status (Age, Disability, Gender, Gender Identity, Gender Expression, Genetic Information, Marital Status, Medical Condition, Nationality, Pregnancy or related conditions, Race or Ethnicity including color, caste, or ancestry, Religion or Religious Creed, Sex including Sex Stereotyping or Sex Characteristics, Sexual Orientation, and Veteran or Military Status), Sexual Harassment, Sexual Misconduct, Sexual Exploitation, Dating Violence, Domestic Violence, Stalking, and Retaliation. Students and employees impacted by any of these types of misconduct are encouraged to access the support they may need. It is important to know that whether a CSUF employee is able to maintain confidentiality depends on the employee’s position and responsibilities at the university.

Most CSUF employees are considered Responsible Employees. This means that they have a responsibility to report to the Office for Civil Rights and Equity if they know or have reason to know of any acts or allegations that may violate the CSU Nondiscrimination Policy, including any instances of Discrimination or Harassment based on a Protected Status, Sexual Harassment, Sexual Misconduct, Sexual Exploitation, Dating Violence, Domestic Violence, Stalking, or Retaliation. Responsible Employees are required to maintain the privacy of those involved, but they are not confidential, in that they do have an obligation to report to the Office for Civil Rights and Equity. Privacy is the practice of limiting those who have access to information to people who, due to their role, have a legitimate “need to know” in order to fulfill their duties. Confidentiality is the legal obligation not to share information without explicitly granted permission from the individual who disclosed it and/or as required by law. Confidentiality applies to Campus Confidential Advocates, physicians, psychotherapists, and professional licensed counselors, licensed clinical social workers acting solely in those roles or capacities as part of their employment.   

Resources are available to CSUF students and employees who may have experienced Sexual Harassment, Sexual Misconduct, Sexual Exploitation, Dating Violence, Domestic Violence, Stalking, Retaliation, and/or Discrimination or Harassment based on any Protected Status. These resources are available for those who have experienced harm whether they have chosen to report the incident to the university or not. Individuals impacted by Sexual Misconduct, Sexual Assault, Sexual Exploitation, Dating Violence, Domestic Violence, and Stalking have specific rights and options outlined in Attachment D of the CSU Nondiscrimination Policy.

Additionally, the Office for Civil Rights and Equity can implement Supportive Measures, which are individualized services designed to promote safety and restore or preserve a student's or employee's equal access to CSU education programs and activities, including classes, extracurricular activities, and employment. S upportive Measures may include No-Contact Directives, referrals to resources, increased security monitoring, or adjustments to academic, living, or working situations. Those impacted by alleged violations of the CSU Nondiscrimination Policy or impacted by a resolution process through the Office for Civil Rights and Equity may access Supportive Measures by communicating with the Office for Civil Rights and Equity directly. Students or employees who have experienced Sexual Misconduct, Dating Violence, Domestic Violence, and/or Stalking also have the option of working with the Campus Confidential Advocates, who will work with the Office for Civil Rights and Equity to implement Supportive Measures. The Office for Civil Rights and Equity can discuss and implement Supportive Measures for those impacted by alleged misconduct before, during, after, and outside of any university investigation process or Informal Resolution process as outlined in the CSU Nondiscrimination Policy.
